Terms of Use

1. Acceptance of these terms

Spargo.ai operates the spargo.ai website and app (the "service"). In these terms "we" is Spargo.ai, its operator, and "you" is the person or organization using it. Creating an account, signing in, or using the service means you accept these terms and our Privacy Policy. Do not use it if you disagree; accepting for a company confirms you may bind it.

2. Accounts and eligibility

You must be 18 or older, or the age of majority where you live, and an account is for one person. You sign in with Google, with Apple, or with a one-time code we email you, so keep those accounts secure. You are responsible for all activity under your account, including everything the agents do on your instructions; report unauthorized use to [email protected].

3. The service

Spargo.ai gives you autonomous growth agents. On your instructions they analyze your market, create marketing content and campaigns, distribute them to the platforms you connect, find and qualify sales leads, run outreach, and analyze results; in Auto Mode they also propose and run the experiments you allow. It also hosts the websites it builds for you, on a spargo.ai subdomain or a custom domain you connect. We may add, change, or discontinue features.

4. Credits, plans and billing

Credits are the unit of usage: every agent action, from generating content to calling an AI model, consumes credits at the rate shown in the app; every account also receives a free daily grant of credits. Paid plans, billed monthly or annually in US dollars plus applicable taxes, add a monthly credit allowance. Stripe processes payments; Spargo.ai never stores card numbers. Plans renew until you cancel, cancellation takes effect at the end of the period already paid for, consumed credits are not refundable, and unused monthly credits do not carry over.

5. Acceptable use

Comply with the terms of every platform and provider you connect: Google, Meta, X, LinkedIn, TikTok, your email provider, and any lead-data provider. Do not send spam or contact people you have no lawful basis to contact; do not run deceptive, harassing, or unlawful outreach, publish illegal, infringing, or harmful content, or break, overload, or reverse engineer the service or reach another customer's data. We may suspend accounts that breach this section.

6. Your content and AI-generated output

You keep ownership of what you upload and grant us the license we need to run the service: to store, process, display, and distribute it on your instruction. Output generated for you is yours to use, including commercially, subject to the third-party AI model providers' terms. AI output can be inaccurate, so review it before publishing or sending.

7. Connected platforms and third-party services

Connecting an account authorizes us to act on it on your behalf, only as you instruct; you can revoke that access at any time, here or on the platform, which may stop running work. Third-party services set their own terms, limits, and availability; we are not responsible for their acts or outages.

8. Hosted websites and custom domains

Websites you publish are your content and your responsibility: their claims, legal notices, and any visitor data they collect. You control the DNS for a custom domain and must hold the right to use it. We may take down hosted content that breaches these terms or the law.

9. Intellectual property

Spargo.ai, its software, name, logo, and documentation remain ours or our licensors'. These terms grant a right to use the service, not a right in it: do not copy, resell, reverse engineer, or scrape it, or build a competing product.

10. Disclaimers

The service is provided "as is" and "as available", without warranties of any kind. We do not guarantee that it will grow your business, that leads or contact data are accurate, that messages will be delivered or accepted by any platform, or that the service will be uninterrupted.

11. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability is limited to what you paid us in the twelve months before the claim arose.

12. Indemnity

You will defend and indemnify us against claims, damages, losses, and legal costs arising from what you upload or publish, the outreach you send, the lead data you use, or your breach of these terms.

13. Termination

You may close your account at any time by email to [email protected]. We may suspend or end your access for breach, where the law requires it, or where your use puts the service or other customers at risk; your access then ends and we may delete your content after a reasonable period. Sections 6, 9 to 12, and 15 survive termination.

14. Changes to these terms

We may update these terms as the service changes, posting the current version here with a new "last updated" date and flagging material changes by email or in the app. Continued use means you accept the update.

15. Governing law and contact

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules, and the Delaware courts have exclusive jurisdiction over any dispute arising out of or relating to these terms. Unenforceable provisions do not affect the rest. Questions go to [email protected].
